As we wrote in one of the previous articles (available here), the implementation of the new Law on Archival Material and Services („Law“) began on February 2, 2021, which provided a number of obligations for creators and holders of archival material and documentary materials.

Obligation to submit a transcript of the book of archives

Article 9 of the Law prescribes the obligation for creators and holders of archival material and documentary material to submit to the competent archive a transcript of the book of archives for documentary material created in the previous year by April 30 of the current year at the latest.

Just to remind you, the creators and holders of archival material are legal or natural persons whose activities generate archival materials and who are the holders of rights to the archival materials, while the book of achives in terms of the Law is the basic record of all archival material and documentary material created in the work of creators and which is kept on the prescribed form.

Penalties for legal entities

If the creators and holders of archival material and documentary material do not fulfill the obligations prescribed by the Law, including the obligation to submit a transcript of the book of archives, fines in the amount of RSD 50,000 to 2,000,000 are prescribed for a legal entity, or RSD 5,000 to 150,000 for the responsible person in the legal entity.
